Welcome to SAKU. These terms and conditions ("Terms") apply to your use of our online platform available at www.saku.co.in (the "Website"). By accessing the Website, you agree to be bound by these Terms. Please read them carefully before using our services.

We may update these Terms from time to time. You will be notified of any material changes via email or through the Website. Continued use of our services after such updates constitutes acceptance of the revised Terms.

You agree not to misuse our services, including: 

• Posting harmful content that could negatively impact our business. 
• Interfering with the security or accessibility of our Website. 
• Using automated systems (e.g., bots) to access or copy content without authorisation. 
• Violation of these provisions may result in account termination and access restriction. 

Prices displayed on the Website include applicable taxes but exclude delivery charges, unless otherwise specified. We reserve the right to adjust prices due to tax changes post-order confirmation without prior notice.

Order Placement and Contract

To place an order: 

• Browse and add products to your cart. 
• Select delivery or click and collect option. 
• Proceed to checkout, provide payment details, and confirm your order. Once confirmed, you will receive an order summary via email.

We aim to dispatch orders promptly and deliver within 15 business days unless stated otherwise. Delivery details will be provided upon order confirmation. Delayed deliveries due to unforeseen circumstances are beyond our control.

All exchanges and refunds are subject to our policy available on our Return Policy page. Certain conditions apply, including return fees for non-defective items.

Accepted payment methods are specified during checkout. Payment processing is handled by our Payment Gateway provider, subject to validation checks.

Products displayed on SAKU's website strive for accuracy but may not always be error-free. SAKU does not guarantee that product descriptions or content are fully accurate, complete, reliable, current, or without errors. If a product from SAKU does not meet the description, you may contact us within 48 hours of receipt, and we reserve the right to offer a resolution at its discretion. SAKU does not guarantee refunds, exchanges, or returns as a matter of policy.

Products sold on the SAKU website adhere to applicable local laws and Indian industry standards.

Unless otherwise indicated or expressly mentioned, SAKU owns all Intellectual Property Rights to and into the Website, including but not limited to copyrights, patents, trademarks, trade names, service marks, designs, know-how, trade secrets, inventions, goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce, or distribute any content from the SAKU Website without obtaining authorisation from SAKU. 

Users are prohibited from uploading, posting, or otherwise making available on the Site any material protected by copyright, trademark, or other proprietary rights without the express permission of the owner. SAKU is not obligated to provide indications or markings to assist Users in determining copyrighted or trademarked materials. Users are solely liable for any damages resulting from any infringement of copyrights, trademarks, proprietary rights, or other harm from such submissions. 

By submitting material to any public area of the Site, Users warrant that the owner of such material has granted SAKU the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, distribute, and incorporate such material in other works. Users also permit other end users to access, view, and store or reproduce the material for personal use. Users grant SAKU the right to edit, copy, publish, and distribute any material made available on the Site by the User. These provisions apply equally to SAKU, its subsidiaries, affiliates, third-party content providers, and licensors, who may assert and enforce such provisions directly or on their behalf.

The Site contains copyrighted material, trademarks, and other proprietary information protected under applicable copyright laws. SAKU owns a copyright in the selection, coordination, arrangement, and enhancement of such content, as well as in the original content. Users may download, print, or save copyrighted material for personal use only. No copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material is permitted without express permission from SAKU and the copyright owner.  Users may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or exploit any content, in whole or in part, without permission. No changes in or deletion of author attribution, trademark legend, or copyright notice shall be made unless expressly permitted by SAKU. Trademarks on the Site or associated websites remain the exclusive property of SAKU, unless under license from the trademark owner.

We are not liable for indirect or consequential losses. Our liability is limited to the total order value. We are not responsible for tampered parcels if not reported at delivery.

We comply with Consumer Protection (E-Commerce) Rules, 2020. Contact details for our Grievance Officer and Nodal Person are available upon request.

If any part of these Terms is deemed invalid, the remainder will continue to apply.  By using our Website or App, you agree to these Terms. Governing Law & Jurisdiction
These Terms of Service, and any separate agreements whereby we provide you Services, shall be governed by and construed in accordance with the laws of India.
All disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.
